General principles

The artist Yves-Léonardo Marchon is the owner of the copyright, moral and patrimonial rights. All elements contained on the mcitys.fr site (texts, images etc.) are the exclusive property of Yves-Léonardo Marchon. Any reproduction for public or commercial use, even partial, of each of these contents, cannot be made without authorization from the right holder.

All elements appearing on the Site are protected by copyright, trademark law and all other intellectual property rights.

No reproduction and/or adaptation may be made without the authorization of Yves-Léonardo Marchon.

GDPR

For their proper functioning, certain services require the transmission of personal data. The personal data entered when creating an order (surname, first name, postal address, email address, telephone number) makes it possible to ensure the operation of the subscribed services (order, delivery and invoicing).

When using the contact form, an email address is required in order to provide a response to the Customer.

The archived data is stored for a period imposed by law, in order to respond to any control request from the competent authorities.

In accordance with the European regulation on the protection of personal data,

- to request information on the processing of your personal data;

to obtain access to personal data held about you;

to request that incorrect, inaccurate or incomplete personal data be corrected;

The Seller is not responsible for the possible inability to access the servers which host the web applications. The Seller is not responsible for the quality of the internet network or the technical maintenance (hardware) of the servers.

Terms and Conditions of Sale for Individuals

Preambule

These General Terms and Conditions apply to all commercial relations between Yves-Léonardo Marchon, SIRET number 84478363900017, and any person (professionals excluded) purchasing objects or transferring reproduction rights on the mcitys.fr  Website. In the context of these transactions, Yves-Léonardo Marchon is designated as Seller, and the person who acquires tangible or intangible goods is named the Client.

No order on the site can be placed without acceptance by the Customer of these General Terms and Conditions.

Orders

Les commandes sont prises en compte par le Vendeur à partir du moment où ce dernier accepte le paiement du Client.

Les photographies illustrant les produits, de manière aussi précise que possible pour une parfaite information du consommateur, ne constituent toutefois pas un document contractuel.

Prices & Currencies

The prices are printed in euros. All prices displayed are inclusive of all taxes. The prices indicated on the Website may be modified at any time. The prices invoiced are those in effect at the time of the order. Promotions are valid during the period indicated on the Website, subject to acceptance by the Seller of the order, your payment, and while stocks last.

Export: Any duties and taxes upon entry into the territory are the responsibility of the Customer.

Payment

Security of online transactions

Any data exchange with our online server is secured using the TLS protocol, the certificates of which are provided by the Let's Encrypt organization. Data is encrypted with the SHA256 algorithm. Your personal data cannot therefore be intercepted during their transmission to our server.

The online payment modules used by the mcitys.fr website were developed by Prestashop and Paypal.

The 3D secure payment option is activated on the mcitys.fr website

Transfer of ownership

The transfer of ownership of the products from the Seller to the Customer occurs when the entire amount requested by the Seller has been paid by the Customer.

Delivery

The Customer's order will only be taken into consideration and shipped after acceptance of payment by the Seller. Once payment is accepted, products are shipped within 2 to 3 business days. The products shipped travel at the Seller's risk.

Deliveries to mainland France

The transport of artworks and products is done via the Colissimo offer from the French Post. For mainland France, a flat rate contribution of €5.90 is required for any order worth less than €75 including tax (excluding shipping costs). Beyond that, delivery is free. Delivery time: between 48h and 72h.

EU deliveries

The transport of artworks and products is done via the Colissimo International offer from the French Post. A flat rate contribution of €13.50 is requested for any order worth less than €100 including tax (excluding shipping costs). Free delivery from 100€ of purchases.

Delivery time: between 3 and 8 days.

Deliveries outside the EU.

Deliveries available to the following destinations : Andorra, Iceland, Norway, Switzerland.

  • For home deliveries, a flat rate contribution of 13.50 is requested for any order worth less than 100€ including tax (excluding shipping costs). Free delivery from 100€ of purchases. Delivery time: between 3 and 10 days.

  • For pick-up stations deliveries, if available, a flat rate contribution of 9.90€ is requested for any order worth less than 100 including tax (excluding shipping costs). Free delivery from 100€ of purchases. Delivery time: between 3 and 10 days.

Customs

If the Customer orders goods for delivery outside of mainland France, please note that the consignment may be subject to VAT (Value Added Tax), other taxes, customs duties and/or fees levied by the destination country. Any such charges levied in relation to customs clearance must be borne by the Customer. It is accepted by the Customer that the Seller has no control over additional charges in relation to customs clearance.

Returns

Right of withdrawal

In accordance with current legislation, the Customer who has purchased a product online on the mcitys.fr Website may exercise his or her right of withdrawal within a maximum of 14 days from the date of receipt of said product.

When the 14-day period expires on a Saturday, Sunday or public holiday, it is extended until the first following working day.

The cost of the return is the responsibility of the Customer. It is the Customer's responsibility to properly package the returned product. Any item not returned in its original condition will not be exchanged or refunded. Only the amount of returned products is refundable. No refund of delivery costs.

The right of withdrawal also applies to promotional items.

Return on defective product

The Customer who purchased a product online on the mcitys.fr Site may return said product if it arrived in poor condition. Proof will be requested by the Seller.

Different scenarios:

- damaged works of art: the entire amount of the order is reimbursed by the Seller (value of the product + delivery costs).

- frames only damaged (broken glass, for example). At the Customer's choice:

- reimbursement of the value of the frame

- free return of a new frame

- return of the frame and the undamaged artwork/reproduction.

Customized products, at the Customer's request

Products designed to measure, at the Customer's request, cannot be returned or refunded.



Procedure to follow to make a return

All returns must be declared online before being sent to the Seller.

Returns that do not comply with the following procedure will be refused.



To declare/request a return, the Customer must go to their Customer area, click on “Order history and details”. The list of orders appears. The Customer must click on the “Details” link corresponding to the order where the item to be returned is located. Then, on the order detail page, the Customer must check the item they wish to return and indicate a reason for return in the text field located under the heading “Merchandise return”. Finally, the return form must be validated by clicking on the “Return a product” button. The Customer must wait for the Seller to accept the return request before returning the product concerned. Any product returned without prior acceptance from the Seller will be refused.

Litigation

The European Commission allows consumers to resolve disputes online on one of its platforms, in accordance with art. 14 para. 1 of the ODR. The platform (https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=FR) acts as a website where consumers can try to resolve disputes arising out of court. purchasing goods or services online.

The artist Yves-Léonardo Marchon remains the owner of the copyright, moral and patrimonial rights. It is necessary to have the authorization of the artist for any exploitation of these rights. The purchase of a work of art or one of its derivatives on Mcitys.fr is not accompanied by a transfer of copyright, moral and/or patrimonial rights.
